1. Who we are
Formabi is a form-building and data-collection service operated by [LEGAL ENTITY NAME], [LEGAL FORM] registered in England & Wales (company no. [COMPANY NO.]), registered office [REGISTERED ADDRESS]. In these terms, “we”, “us” and “Formabi” mean that company, and “you” means the person or organisation using the service.

2. Your account
You need an account to use Formabi. You’re responsible for keeping your login details safe and for everything done under your account. Tell us promptly if you think someone else has access. You must be at least 18 and able to enter into a contract.
3. Acceptable use
Use Formabi lawfully and considerately. Don’t:
- break the law, or collect data you have no right to collect;
- upload malware, or try to break, overload, or gain unauthorised access to the service;
- send spam, or use Formabi to harass or defraud people;
- resell or copy the service, or reverse-engineer it beyond what the law allows.
If someone’s use puts others at risk, we may act quickly to protect the service (see section 8).
4. Your data
Your form definitions and the responses you collect are yours. We don’t sell them or use them for advertising. We process them only to run the service for you, as described in our Privacy Policy.
For the personal data your respondents submit through your forms, you are the controller and we act as your processor. A data processing agreement (DPA) covering this is available on request at help@formabi.com.
You’re responsible for having a lawful basis to collect what you collect, and for the content of your forms.
5. Plans, payment and cancellation
Paid plans are billed in advance for the period you choose (for example monthly or yearly) and renew automatically until you cancel. Prices are shown on our pricing page and may include tax.
You can cancel any time from your account; cancellation takes effect at the end of the current paid period, and you keep access until then. We don’t give pro-rata refunds for a period already started, except where the law requires it. If you’re a consumer in the UK or EU, your statutory cancellation and withdrawal rights are unaffected by anything here.
Payments are handled by our payment provider, Mollie (see sub-processors). If a payment fails, we may suspend the service until it’s resolved.
6. Availability and changes
We work hard to keep Formabi available and improve it, but we don’t promise it will never be interrupted. We may add, change, or remove features. If we plan a change that materially reduces the service, we’ll give you reasonable notice where we can.
7. Our responsibility
Formabi is provided “as is”. To the extent the law allows, we exclude implied warranties and are not liable for indirect or consequential loss, or for lost profits, revenue, or data. Our total liability to you in any 12-month period is limited to what you paid us in that period. Nothing here limits liability that can’t be limited by law (such as for death or personal injury caused by negligence, or for fraud).
You keep your own backups of anything important. We describe our security measures on our security page.
8. Suspension and termination
You can stop using Formabi and close your account at any time. We may suspend or end your access if you seriously or repeatedly breach these terms, or if we must to protect the service or comply with the law — we’ll aim to warn you first where it’s reasonable to do so. After your account closes we delete your data in line with our Privacy Policy; you can export it beforehand.
9. Changes to these terms
We may update these terms from time to time. If a change is significant we’ll let you know (for example by email or a notice in the app) before it takes effect. Continuing to use Formabi after that means you accept the new terms.
10. Governing law
These terms are governed by the laws of England & Wales, and disputes are subject to the courts of England & Wales. If you’re a consumer, you may also have the benefit of mandatory rules and courts of the country where you live.
